District Attorney General’s Statement on the R. Larry Smith Case

In the recently released R. Larry Smith case file from the investigation of a 2/27/2017 incident, first reported here on 3/3/2017  is an email from an Assistant District Attorney in Anderson County District Attorney Dave S. Clark‘s Office to the Investigator, it said in part, I have discussed this case at length with General Clark after again carefully reviewing the evidence in the file, our interview with the victim, and the relevant case law. 

While I found the victim to be very credible, I do not believe we could prove the case beyond a reasonable doubt. As such, we are declining to prosecute this case…

In this day and age of Harvey Weinstein, Bill Cosby and others it really does highlight how victims of sexual assault crimes do not come forward when the prosecution has to determine whether a he said, she said could sway a judge or jury.
